Appeals & Reviews
A rejected DVA decision is the start of a process, not the end of one.
DVA delegates make mistakes. Conditions get rejected on technical grounds that can be overturned. Evidence that was missing at lodgement can be gathered and resubmitted. The review system exists specifically because initial decisions are not always correct, and veterans have formal rights to challenge them.
We review the original decision, identify the grounds for challenge, gather additional supporting evidence where required, and prepare the written submission. For Veterans Review Board hearings, we attend and present your case.
Your options when a DVA decision goes against you
There are two main formal review pathways available to veterans before further escalation. The right one depends on what was decided and where you are in the process.
How we help
We review the original DVA decision and identify specific errors in the delegate's reasoning or gaps in the evidence considered.
We gather additional medical and factual evidence to address the grounds on which your claim was rejected.
We prepare a written submission setting out the legal and factual basis for overturning the decision.
We attend VRB hearings and present your case to the Board, including responding to any questions from the presiding member.
We give you an honest assessment of your prospects before committing to an appeal, so you can make an informed decision.
What to expect when you work with us
Decision Review
We review the DVA decision letter and the reasoning used by the delegate. We identify where the decision went wrong and whether grounds for appeal exist.
Evidence Gathering
We identify what additional evidence is needed and gather it. This may include specialist medical reports, clarification from treating doctors, or additional service records.
Submission Preparation
We prepare your written submission, setting out the factual and legal basis for the appeal and attaching all supporting evidence.
Hearing and Outcome
For VRB hearings, we attend with you and present your case. We advise you on the outcome and what options remain if the appeal is unsuccessful.
